29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. a. On or about December 15, 2016, at the facility located at N1893 Maloney Road Kaukauna, WI, the Toyota forklifts, used for material handling operations and had fuel flow issues resulting in excessive amounts of carbon monoxide to be produced, were not removed from service until they could be restored to safe operating conditions.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a. The employer did not have a program for inspections of the job site and equipment to monitor for excessive amounts of Carbon Monoxide while using the LP gas powered Genie Self-propelled Telescoping Boom to prepare walls of the facility for painting.
