29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards: Big Ox Energy - Siouxland, LLC - 1617 D Avenue - Dakota City, Nebraska - The employer is failing to identify and monitor the levels and types of toxic gases that employees were exposed to when accessing the digester atmosphere during pipe installation. On or about December 14, 2016 at approximately 6:45 p.m., employees not wearing respirators were exposed to high levels of toxic gases including, but not limited to hydrogen sulfide and methane. Digester air monitoring readings were last taken and recorded at 12:00 p.m. (noon) on December 14, 2016. One employee required CPR to be revived after exposure to the digester gases.

29 CFR 1910.1020(e)(2)(i)(A)(1): A record which measures or monitors the amount of a toxic substance or harmful physical agent to which the employee is or has been exposed was not maintained by the employer. Employer is failing to ensure that data-logging air contaminant monitors worn by employees are assigned or used in a manner to allow records of individual employee exposure to hazardous chemicals. Employees are exposed to hazardous air contaminants including, but not limited to hydrogen sulfide, methane, and carbon monoxide. Employee monitoring records indicating their individual levels of air contaminant exposure were not available upon agency request for an incident on or about December 14, 2017, where employee(s) inserting a pipe into the digester were exposed to high levels of digester head space gases. One employee/manager had to be revived with CPR after exposure to the digester gases.
