29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    (a)    The employer did not implement a Hearing Conservation program with all of its requirements (such as provision of suitable hearing protectors, medical monitoring, recordkeeping, and training).  An employee making pallets on the west side of the shop, using a nail gun, and helping with the table saw operation was exposed to a cumulative noise dose of 77.3% during a 466 minute sampling period on January 10, 2017.  This noise exposure equated to an 8-hour time weighted average sound level of approximately 88.2 dBA; the 8-hour time weighted average determination included zero increment for the unsampled 14 minutes.      b)    The employer did not implement a Hearing Conservation program with all of its requirements (such as provision of suitable hearing protectors, medical monitoring, recordkeeping, and training).  An employee building boxes at the east side of the shop, using a  nail gun, and operating the "Run-A-Gade" was exposed to a cumulative noise dose of 123.5% during a 387 minute sampling period on January 10, 2017. This noise exposure equated to an 8-hour time weighted average of approximately 91.5 dBA; the 8-hour time weighted average determination included zero increment for the unsampled 93 minutes.

29 CFR 1910.147(d): 29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) was not done in sequence as required by 29 CFR 1910.147 (d)(1)-(6):    (a)   SawStop Cabinet Saw:  Employees were potentially exposed to machine hazards associated with unexpected start-up of the saw while they changed the saw blade and brake parts.  The saw was shut off at its electrical disconnect, however no lockout/tagout device was applied to the electrical disconnect as required by 29 CFR 1910.147(d)(4).

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly and in a sanitary condition.  (a) In the west side of the shop, particularly in the vicinity  of the Delta X Saw, there was excessive accumulation of wood dust on horizontal surfaces including, but not limited to:  the floor between the work bench and the west wall, a sprinkler pipe which ran horizontally along the west wall approximately 10 feet above floor level, and a ledge also approximately 10 feet above floor level.
