29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    On or about December 21, 2016 at a worksite located at 206 First Street NE, Massillon, OH, during commercial construction activities, including leading edge carpentry work, employees were exposed to fall hazards of approximately 10-13 feet while ascending and descending the ladder. The ladder did not extend at least three feet above the upper work surface.

29 CFR 1926.1060(b): The employer did not provide retraining as necessary so that each employee exposed to fall hazards maintained the understanding and knowledge acquired through initial training:    On or about December 21, 2016 at a worksite located at 206 First Street NE, Massillon, OH, during commercial construction activities, including leading edge carpentry work, employees were exposed to fall hazards when the employer did not provide retraining for employees using ladders. Employees were observed using an extension ladder not properly extended to exit the upper working surface and using a step ladder top step to gain access to upper working surface.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:     On or about December 21, 2016 at a worksite located at 206 First Street NE, Massillon, OH, during commercial construction activities, including leading edge carpentry work, the employer did not ensure employees were protected from fall hazards of approximately 23 feet (upper working surface to ground) by utilizing a guardrail system, safety net system, and or other fall protection system or device.    TroyMill Builders LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1132640, citation number 01, item number 001 and was affirmed as a final order on May 25, 2016, with respect to a workplace located at 1559 Weymouth, Westlake, OH 44145.
