29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a) In the production area, on or about and at times prior to December 21, 2016, the employer did not remove from service a Yale sit down style forklift (forklift number 2) that had a non-functioning horn, exposing employees to struck-by hazards. b) In the maintenance area, on or about and at times prior to December 21, 2016, the employer did not remove from service a Yale sit down style forklift (forklift number 5) that had a non-functioning horn, exposing employees to struck-by hazards. c) In the production area, on or about and at times prior to December 21, 2016, the employer did not remove from service, a Yale sit down style forklift (forklift number 6) that had a non-functioning back up alarm, exposing employees to struck-by hazards.
