OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards: (a) Production Area Jelly Cup Line: On or about December 20, 2016, the employer exposed employees to amputation hazards when the access doors of the jelly cup filling machine (O1D) were opened during adjustments, leaving moving parts unguarded, such as the block assembly, exposing the employees to moving parts.

29 CFR 1910.147(c)(7)(i)(B): Training and communication. The employer shall provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees. The training shall include the following: Each affected employee shall be instructed in the purpose and use of the energy control procedure. a) Production Area Jelly Cup Line: On or about December 20, 2016, and at times prior, the employer did not assure employees were protected from amputation hazards while operating the Line D Jelly Cup Filling machine (01D), in that packers (affected person) were not trained to understand the purpose and use of the energy control procedures.

Notification shall be given before the controls are applied, and after they are removed from the machine or equipment. a) Production Area Jelly Cup Line: On or about December 20, 2016, and at times prior, the employer did not assure employees were protected from caught-in hazards while operating the Line D Jelly Cup Filling machine(01D) in that a method of notification was not established as part of the energy control procedure when applying and removing locks.
