29 CFR 1910.178(k)(2): Wheel stops or other recognized positive protection shall be provided to prevent railroad cars from moving during loading or unloading operations. On or about December 20, 2016, at the shipping port area of the NYS in-plant rail operations, an employee Remote Control Operator ('RCO') wearing an OEM Cattron Theimeg remote control model MP96/48, Model Number 65540051 (the Cattron Remote Control Transmitter or "Cattron RCT") involved in the cited incident did not confirm that the Remote Control Locomotive 198 ("RCL, 198") had a functioning audible or visible alarm or warning device indicating to nearby personnel that RCL 198 was under active RCT and subject to movement before coupling/uncoupling of a railcar attached to RCL 198.
