29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. a) On or about December 21, 2016, employees were exposed to fall hazards of approximately 17 feet 11 inches while installing a metal roof on a 4 in 12 pitched roof, in that, employees working near or around skylights were not using fall protection. The skylights were not capable of supporting, without failure, twice the weight of employees.

29 CFR 1926.761(b): The employer did not train each employee exposed to a fall hazard in accordance with the requirements of 29 CFR 1926.761: a) On or about December 21, 2016, employees exposed to fall hazards when working near or around skylights were inadequately trained, in that, employees were allowed to spray paint the skylights to warn the employees of the fall hazards instead of using fall protection.
