29 CFR 1910.147(c)(7)(iii)(A): Retraining was not provided for authorized and affected employees when there was a change in the energy control procedures: a) Throughout the Establishment - On or about December 27, 2016, the employer had not retrained all authorized and affected employees after creating the procedure for the gas heaters in the Chocolate Room and revising other procedures. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: a) Throughout the Establishment - On or about December 27, 2016, the employer failed to provide all employees with effective information and training on the chemical-specific health and physical hazards, including signs and symptoms of overexposure, or the methods and observations that may be used to detect the presence of and associated with, the toxic asphyxiant carbon monoxide at the time of their assignment working in or around the Chocolate Room and the Loading Dock. No abatement certification or documentation required.
