29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a)  An employee, working on the exit oven side of the Insulwasher, was exposed to a noise level of 90.9%, or an equivalent dBA (decibels 'A' scale) of 89.3 dBA, which was capable of causing hearing loss.  The sample was performed for 472 minutes during one work shift on May 2, 2017.  The employer had not established nor implemented an effective hearing conservation program.  Zero exposure was assumed for the unsampled time period of 8 minutes.      b)  An employee, working on the exit of the Insulwasher, was exposed to a noise level of 76.8%, or an equivalent dBA (decibels 'A' scale) of 88.1 dBA, which was capable of causing hearing loss.  The sample was performed for 476 minutes during one work shift on May 2, 2017.  The employer had not established nor implemented an effective hearing conservation program.  Zero exposure was assumed for the unsampled time period of 4 minutes.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
