29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling.    a. On or about December 27, 2017, a temporary employee performed maintenance activities on top of a thermal oxidizer that was approximately 20 feet above ground level and was not protected from falling with a fall protection system, such as but not limited to, guardrails or personal fall protection system.      ICS was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.23 (c)(1), which was contained in OSHA inspection number 574370, citation number 1, item number 2(a) and (b), and was affirmed as a final order on November 14, 2012, with respect to a workplace located at 135 Blatt Blvd., Gahanna, OH, 43230.

29 CFR 1904.4(a): Basic requirement. Each employer required by this Part to keep records of fatalities, injuries, and illnesses must record each fatality, injury and illness.    a. Located at ICS in Gahanna, OH:    On the 2016 OSHA 300 log, the employer did not enter all recordable work related incidents that resulted in days away.      1. HC, on 8/16/16, sustained a sprain to the right knee resulting in one day away.      2. LW, on 8/16/16, sustained a back strain resulting in two days away.
