29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Exterior Top Plate, new residential construction: On or about December 29, 2016 and time prior, the employer exposed employees to fall hazards of 9 feet, 5 inches to the ground in that they were nailing down 2x4s on the top exterior plate without a personal fall arrest system.     The employer, Daniel Hernandez, was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 981895, citation number 1, item number 1 and was affirmed as a final order on August 6, 2014, with respect to a workplace located at Lots 5-8 Tree Arbor Way, Marietta, GA. 30080.
