OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards where: Location: Jobsite On or about January 13 2107 an employee was exposed to fall hazards of up to 29 feet from the top rails of an Up-right self-propelled scissors lift model Skyjack SJ683ZRT while climbing as well as standing on the guardrails and exiting the lift to access the upper level of the structure they were working on.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. Location: Jobsite An employee was exposed to falls greater than 15 feet to the ground below, while working on a horizontal steel beam where fall protection had not been used.
