29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact. A. Pellman & Associates, Inc. worksite located at 370 N. Eastown Rd., Lima, Ohio: On or about January 17, 2017, the employer did not ensure employees were provided with proper eye protection while operating pneumatic nail guns to secure asphalt shingles. Two employees were exposed to potential flying object hazards while operating the pneumatic fasteners.

29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems. A. Pellman & Associates, Inc. worksite located at 370 N. Eastown Rd., Lima, Ohio: On or about January 17, 2017, the employer did not ensure employees applying weatherproofing and performing framing activities on the 6/12 pitch commercial structure were wearing fall protection. Employees were exposed to a fall distance of approximately 10.00 feet.
