29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  a) Roof of old Sears building - Employees were working with and exposed to non-friable asbestos containing roofing materials. Employees were not provided with an up to date, company specific written Hazard Communication Program on or about 1/19/2017.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.852(a): No material shall be dropped to any point lying outside the exterior walls of the structure unless the area is effectively protected.  a) Back of vacant Sears building - A Microtech employee was throwing roof material off the edge of the building into the dumpster below without the use of a chute. Microtech and other contractors walk by the dumpster as this is a main walkway for the project site on or about 1/19/2017.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1101(k)(8)(i): Labels shall be affixed to all products containing asbestos and to all containers containing such products, including waste containers. Where feasible, installed asbestos products shall contain a visible label.  a) Back of vacant Sears building - Employees were conducting asbestos abatement. All material was stored in the dumpster on site. The dumpster did not have asbestos warning labels on any side on or about 1/19/2017.   Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
