OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that a fixed ladder was not maintained in safe condition. (a) Silo Area - On or about January 20, 2017, the fixed metal ladder on the middle silo was not maintained in safe condition and had not been blocked, fenced or removed to prevent use. The bottom rung on the ladder was bent and the cage was not secure.
