On or about May 4, 2017, and at times prior to, at the establishment, confined space entry permits for 1/9/2017, 1/10/17, 1/11/17, 1/12/17, 2/8/17, 2/9/17, 2/13/17, and 2/14/17 did not identify the employee who entered tanks where chemicals including but not limited to Styrene (toxic, flammable) and Dimethylaniline (toxic, flammable) where used to install fiberglass on interior tank surfaces and which expose employees to potentially hazardous atmospheres in permit-required confined spaces.

29 CFR 1910.146(d)(3)(i): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not develop and implement the means, procedures, and practices necessary for safe permit space entry operations, including specifying acceptable entry conditions: a. On or about January 26, 2017, shop, the permit required confined space program did not specify acceptable air levels for employee entry into acid frac tanks to install fiberglass on interior tank surfaces using chemicals including but not limited to Styrene (toxic, flammable) and Dimethylaniline (toxic, flammable) which expose employees to potentially hazardous atmospheres. b. On or about January 26, 2017, shop, the permit required confined space program did not specify the use of explosion proof electrical equipment including, but not limited to lighting used inside acid frac tanks when employees enter to install fiberglass on interior tank surfaces using chemicals including but not limited to Styrene (toxic, flammable) and Dimethylaniline (toxic, flammable) which expose employees to potentially hazardous atmospheres. Miracle Production, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1910.146(d)(3)(i) which was contained in OSHA inspection Number 1095587, citation number 1, item number 4, and was affirmed as a final order on February 24, 2016 with respect to a workplace located at 9500 SW 15th Street, Oklahoma City, OK 73128.
