29 CFR 1926.302(b)(3): All pneumatically driven nailers, staplers, and other similar equipment provided with automatic fastener feed, which operate at more than 100 p.s.i. pressure at the tool shall have a safety device on the muzzle to prevent the tool from ejecting fasteners, unless the muzzle is in contact with the work surface.     On or about January 25, 2017 employees were exposed to being struck by flying objects.  The employees were framing a newly constructed residential home located in Strongsville, Ohio 44149. The employees were using an air powered nail gun that had the safety device frozen on the muzzle of the nail gun in the open position and/or had the spring coil removed/taken-out, which failed to prevent fasteners from ejecting.

Cloverhill Construction LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1064730, citation number 01, item number 01 and was affirmed as a final order on June 23, 2015 with respect to a workplace located at 12504 Saddlebrook, Strongsville, OH 44136.
