29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  a) Laborer:  On or about February 1, 2017 and at times prior; the employer exposed the employees operating in the foundry area to noise at levels of 104.6% (equivalent to an 8 hour time weighted average TWA of 90.6 dBA) which is 2.1 times the action level of 50% (equivalent to an 8 hour TWA of 85dBA) while working in the Borbet Alabama Plant.  Results were calculated for a 505 minutes sampling period.  The employer did not administer a continuing, effective hearing conservation program.    b) Laborer:  On or about February 1, 2017 and at times prior; the employer exposed the employees operating in the paint and fabrication areas to noise at levels of 66.2% (equivalent to an 8 hour time weighted average TWA of 87.2 dBA) which is 1.3 times the action level of 50% (equivalent to an 8 hour TWA of 85dBA) while working in the Borbet Alabama Plant.  Results were calculated for a 497 minutes sampling period.  The employer did not administer a continuing, effective hearing conservation program.     c) Laborer:  On or about February 1, 2017 and at times prior; the employer exposed the employees operating in the fabrication area to noise at levels of 102.2% (equivalent to an 8 hour time weighted average TWA of 90.2 dBA) which is 2.0 times the action level of 50% (equivalent to an 8 hour TWA of 85dBA) while working in the Borbet Alabama Plant.  Results were calculated for a 485 minutes sampling period.  The employer did not administer a continuing, effective hearing conservation program.
