29 CFR 1910.176(b): Secure storage. Storage of material will not create a hazard. Bags, containers, bundles, etc., stored in tiers was not stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse.    On or about 29 January 2017, and at times prior thereto, within the Wareroom of the store, palletized product was not securely stored and stacked in such a way as to prevent it from tipping and falling over, exposing the wareroom workers to the hazard of being struck by falling materials and product.

29 CFR 1910.303(b)(7)(iv): Electrical equipment had damaged parts that may adversely affect safe operation or mechanical strength of the equipment, such as parts that are broken, bent, cut, or deteriorated by corrosion, chemical action, or overheating.    On or about 2 February 2017, and at times prior thereto, two dock lights utilized by the night shift to illuminate trailer interiors had damage to both the power receptacles and switches on the metal swing arms, in addition to cord damage, exposing the employees to an electrical hazard of approximately 120 volts.

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours.  On Sunday, 29 January 2017 at approximately 6:00 PM CST, an employee working within the Wareroom fell from the top of the second stack of palletized product to the concrete floor, sustaining injuries which required transport and hospitalization of the employee. The employee suffered a T11 wedge fracture and T5 endplate fracture to their spinal column, requiring surgery. Employee was admitted on 29 January and released on 31 January. First notification to OSHA was Tuesday, 31 January 2017 at 1:39 PM MDT.
