29 CFR 1926.453(b)(2)(iv): Employees shall always stand firmly on the floor of the basket, and shall not sit or climb on the edge of the basket or use planks, ladders, or other devices for a work position.  Located inside a commercial structure, employees were performing framing work while standing on the boom of a JLG Telescopic Boom Lift and sitting on the mid-rail outside of the basket of the JLG Telescopic Boom Lift while exposed to a fall height approximately 6 feet above the ground level below.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  Located inside a commercial structure, employees were performing framing work while inside a JLG Telescopic Boom Lift approximately 6 feet above the ground level below without a personal fall arrest system attached to the boom or basket.   The John Fisher III Contractors was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 971030, citation number 1, item number 1 and was affirmed as a final order on 6/19/2014, with respect to a workplace located at 4753 Dixie Hwy, Fairfield, OH 45014.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
