29 CFR 1910.178(l)(4)(ii)(A): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been observed to operate the vehicle in an unsafe manner: A) Magretech, LLC, located 301 County Road 177, Bellevue, OH 44811: On or about February 2, 2017, the employer did not provide refresher training in safe operation of sit-down powered industrial vehicles for the employee who was observed operating forklifts such as, but not limited to, the Linde forklift # 36 (Model H50T, Serial # H2X394B02127) in an unsafe manner. The operator was observed operating the forklift in the facility at an excessive speed. Employees were exposed to struck-by hazards due to the lack of refresher training.

29 CFR 1910.178(n)(1): Traffic regulations including authorized plant speed limits were not observed: A) Magretech, LLC, located 301 County Road 177, Bellevue, OH 44811: On or about February 2, 2017, the employer did not ensure that the operator of the Linde forklift # 36 (Model H50T, Serial # H2X394B02127) was operating the forklift in accordance with all traffic regulations including authorized plant speed limits. The operator of the Linde # 36 forklift was involved in an incident that resulted in serious personal injuries while the forklift operator was driving in reverse at an excessive speed. Employees were exposed to struck-by and caught-in-between hazards.

29 CFR 1910.178(a)(4): Capacity, operation, and maintenance instruction plates, tags or decals of the powered industrial truck were not changed accordingly: A) Magretech, LLC, located 301 County Road 177, Bellevue, OH 44811: On or about February 2, 2017, the employer did not ensure that data plates of powered industrial vehicles such as, but not limited to, Linde forklift # 36 (Model H50T, Serial # H2X394B02127) were changed in order to identify the capacity of the forklifts with the front end boom attachment. The forklifts with the attachment were used once a week during the furnace cleaning. Employees were exposed to crushing, struck-by, caught in between, and tip over hazards.
