29 CFR 1910.28(b)(6)(i): The employer did not ensure that each employee greater than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard: A) MagReTech, LLC located at 301 County Road 177 in Bellevue, Ohio. On or about May 25, 2023, employees working within the melt room, specifically on the melt deck, were exposed to fall hazards near (4) furnaces used in the process of melting magnesium scrap. Employees were not protected from fall hazards while charging the furnaces. The furnaces contain molten magnesium with temperatures exceeding 1,000 degrees Celsius and are approximately 9 feet in depth. Failure to ensure employees are protected from fall hazards while charging the furnaces exposes employees to potential death and/or permeant dismemberment.

On or about May 25, 2023, employees working within the melt room were exposed to noise greater than 90 decibels. Failure to implement feasible administrative or engineering controls for employees whose exposures are greater than 85 decibels exposes employees to Standard Threshold Shifts, chronic hearing loss, and other irreversible audiometric conditions.

On or about May 25, 2023, the employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures were equal to or exceed an 8-hour time-weighted average of 85 decibels. Employees working within the melt room were exposed to noise greater than 90 decibels. Failure to maintain and ensure audiometric testing for employees whose exposures are greater than 85 decibels exposes employees to Standard Threshold Shifts not able to be identified. This can contribute to chronic hearing loss and other irreversible audiometric conditions.

29 CFR 1910.95(i)(2)(ii): The employer did not ensure that hearing protectors are worn by any employee who is exposed to an 8-hour time-weighted average of 85 decibels or greater: On or about May 25th, 2023, the employer failed to ensure proper fitting and supervise the correct use of all hearing protectors within the stacking area of the melt room. During the personal noise dosimetry sampling event, (2) employees were observed to not wearing the approved hearing protectors identified by the employer. Employee #1 was observed wearing noise canceling earbuds and Employee #2 was observed wearing earmuffs not approved by the Employer. Failure to supervise employees wear of hearing protectors exposes employees to potential Standard Threshold Shifts and chronic hearing loss.

29 CFR 1910.95(k)(1):The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: A) MagReTech, LLC located at 301 County Road 177 in Bellevue, Ohio. On or about May 25, 2023, employees working within the melt room were exposed to noise greater than 85 decibels at a 12-hour time-weighted average. Employees were exposed to noise that reached 100 decibels at a 12-hour time-weighted average during personal noise dosimetry sampling. Failure to ensure employees are trained on the hazards associated with hazardous noise and participate with the hearing conservation programs can contribute to chronic hearing loss, Standard Threshold Shifts, and other irreversible audiometric conditions.
