29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  Note:  The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.   a. Paint Areas/Buildings - On or about February 6, 2017, the employer required employees to wear tight-fitting face piece respirators during spray painting operations and a medical evaluation to determine the ability to use a respirator at the workplace was not conducted. Employees were thereby potentially exposed to health hazards from working with hazardous chemicals.  1. Doka Building - employees weaing half face respirators (with organic vapors cartridges) had not received a medical evaluation to determine the ability to wear respirators at the workplace.    2. Basement Columns Building -  employees wearing half face respirators (with organic vapors cartridges) had not received a medical evaluation to determine the ability to wear respirators at the workplace.

29 CFR 1910.134(f)(1): The employer did not ensure that employee(s) required to use a tight-fitting facepiece respirator passed the appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT):   a. Paint Areas/Buildings - On or about February 6, 2017, the employer required employees to wear tight-fitting face piece respirator during spray painting operations and an appropriate qualitative/quantitative fit tests were not conducted. Employees were thereby exposed to health hazards from working with hazardous chemicals.  1. 29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:   a. Paint Areas/Buildings - On or about February 6, 2017, the employer permitted facial hair between the sealing surface of the tight-fitting facepieces respirators during spray painting operations of hazardous chemicals. Employees were thereby potentially exposed to health hazards from working with hazardous chemicals.  a. Doka Building - employees showing facial hair (mustaches, side burns, beards, and goatees) and wearing half face respirators (with organic vapors cartridges) during mixing operations of hazardous chemicals such as paint and solvents.  b. Basement Columns Building - employees showing facial hair (mustaches, side burns,beards, and goatees) and wearing half face respirators (with organic vapors cartridges) during spray painting operations of metal products with hazardous chemicals such as paint and solvents.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:    a. Paint Areas/Buildings - On or about February 6, 2017, the employer did not ensure that  air -  purifying respirators were stored in a clean and protected place. Employees were thereby exposed to health hazards from hazardous chemicals.  1. Doka Building - a half face respirator (organic vapors cartridges) was missing one of the inhalation valves, the adjusting straps were twisted and worn. Also, the respirator was hanging on the corner of the locker's door.  2. Basement Columns Building -  a half face respirator (organic vapors cartridges) was coated with dust paticules, the adjusting straps were twisted and streched-out. Also, the respirator was hanging on the wall near the building's entrance door.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  a. Paint Shops Buildings - On or about February 6, 2017, the employer required employees to conduct spray painting operations with chemical products containing ingredients such as xylene, toluene, petroleum distillates, ethyl benzene, and a complete written hazard communication program was not maintained and implemented at the company. Employees were thereby exposed to nassal passages and respiratory tract irritations.    1. Basement Columns Building - employees were required to conduct spray painting operations on long cylindrical metal products.  2. Doka Building - employees were required to conduct spray painting operations on long "C" clamp metal products.
