29 CFR 1910.1200(f)(6)(i): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v):    (a) Nidi Tec Inc, at 591 E 56th Avenue, Denver, CO: On and preceding 2/10/17, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information required by 29 CFR 1910.1200(f)(1)(i) through 29 CFR 1910.1200(f)(1)(v).  A solution of Formula 409 Multi-Surface Cleaner and Super Tech Windshield Washer Fluid was contained within a spray bottle.  The secondary container was not labeled with the identity of its contents or hazard information.  This condition potentially exposed employees to a chemical hazard.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified per 29 CFR 1910.178(l):    (a) Nidi Tec Inc, at 591 E 56th Avenue, Denver, CO: On and preceding 2/10/17, Nidi Tec Inc did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified per 29 CFR 1910.178(l).  An employee operated a Caterpillar model GC70K-LP-STR powered industrial truck while transporting bundles of granite slabs.  Each encased bundle of multiple slabs of granite was supported by slings suspended from a spreader bar connected to the forklift's boom attachment.  The rated capacity of the Caterpillar powered industrial truck with boom attachment at the operated load center of 72" was 5,150 pounds.  Bundles of seven six foot by ten foot slabs, total weight approximately 7,210 pounds, were moved.  The weight of the Ausavina AUS-SB8T spreader bar was 357 pounds.  The employer did not ensure that the operator was trained with regards to the capacity of the powered industrial truck and how to calculate the weight of loads.  This condition exposed employees to a powered industrial truck hazard.    Nidi Tec Inc. was previously cited for a violation of this Occupational Safety and Health Administration Standard or its equivalent standard, 29 CFR 1910.178(l)(1)(i), which was contained in OSHA inspection 1121670, Citation 2, Item 4a and was issued on 7/6/2016, and affirmed as a final order on 7/25/2016, with respect to a workplace located at 591 E 56th Ave. Denver, CO.

29 CFR 1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s):    (a) Nidi Tec Inc, at 591 E 56th Avenue, Denver, CO: On and preceding 2/10/17, Nidi Tec Inc did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s).  Employees performed duties related to the sale of granite slabs.  The employer did not maintain safety data sheets for hazardous chemicals in the work area, including but not limited to the following:    1.  Formula 409 Multi-Surface Cleaner;  2.  Super Tech Windshield Washer Fluid; and   3.  Gasoline.    Nidi Tec Inc. was previously cited for a violation of this Occupational Safety and Health Administration Standard or its equivalent standard, 29 CFR 1910.1200(g)(8), which was contained in OSHA inspection 1121670, Citation 2, Item 7b and was issued on 7/6/2016, and affirmed as a final order on 7/25/2016, with respect to a workplace located at  591 E 56th Ave. Denver, CO.

29 CFR 1910.1200(h)(1): Employer had not provided employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees had not previously been trained about was introduced into their work area:    (a) Nidi Tec Inc, at 591 E 56th Avenue, Denver, CO: On and preceding 2/10/17, Nidi Tec Inc had not provided employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees had not previously been trained about was introduced into their work area.  Employees performed duties related to the sale of granite slabs.  The employer had not provided information or training on hazardous chemicals in the work area, including but not limited to the following:    1.  Formula 409 Multi-Surface Cleaner;  2.  Super Tech Windshield Washer Fluid;   3.  Gasoline; and  4.  Propane.      Nidi Tec Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1200(h)(1) which was contained in OSHA inspection number 1121670, citation number 2, item number 7c, issued on 7/6/2016, and affirmed as a final order on 7/25/2016, with respect to a workplace located at  591 E 56th Ave. Denver, CO.
