29 CFR 1910.29(b)(1): (1) The top edge height of top rails, or equivalent guardrail system members, were not 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11). (a) Facility, 12478 US 422, Kittanning, PA: On or about February 15, 2017 the wire rope guardrails in place on the storage area were not 42 inches above the walking-working surface. Several areas of the guardrail dropped several inches or to the floor and did not provide protection for employees working in the immediate area. Employees go to the storage area to retrieve tires that are storage at the edge of the floor and the guardrail is not 42 inches high to provide protection.

29 CFR 1910.29(b)(2)(i): Midrails were not installed at a height midway between the top edge of the guardrail system and the walking-working surface; (a) Facility, 12478 US 422, Kittanning, PA: On or about February 15, 2017 there were no midrails installed along the area where the tires are stored. Employees go up to the storage area to retrieve tires for the trailers exposing them to fall hazards of approximately 10 feet.
