29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:    a) On or about February 14, 2017, in the East and West temporary shelters, the employer did not evaluate the respiratory hazards for employees exposed to hazards associated with sandblasting stop logs such as, but not limited to, asthmatic conditions, silicosis, nervous system and neurobehavioral effects, and impaired kidney function, from exposure to chemicals such as silica and lead dust.

29 CFR 1910.1025(d)(2): An initial determination was not made to determine if any employee may be exposed to lead at or above the action level:   On or about February 14, 2017, in the East and West temporary shelters, the employer did not determine if employees were exposed to lead at or above the action level while performing sandblasting on items such as, but not limited to stop logs.

29 CFR 1910.1025(l)(1)(i): Employee(s) working in an area where there is potential exposure to airborne lead at any level were not informed of the content of Appendices A and B of 29 CFR 1910.1025:     On or about February 14, 2017, in the East and West temporary shelters, an employee with potential exposure to airborne lead during activities such as, but not limited to sandblasting and clean up was not informed of the contents of Appendices A and B of 29 CFR 1910.1025.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve:    (a) On or about February 14, 2017, in the East temporary shelter employees were required to wear 3M Powered Air Purifying Respirators during activities such as but not limited to cleaning after sandblasting, painting and welding, and the employer did not ensure that the respirators were stored to protect it from damage, contamination or dust. Two respirators were sitting on scaffolding with the filter portion of one on the floor.        (b) On or about February 15, 2017, in the West temporary shelter employees were required to wear 3M Powered Air Purifying Respirators during activities such as but not limited to welding, and the employer did not ensure that the respirators were stored to protect it from damage, contamination or dust. During a break an employee left his respirator unprotected in the shelter while other employees continued welding in the shelter.     The U.S. Army Corps of Engineers was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1910.134(h)(2)(i),  which was contained in OSHA inspection number 1047433, citation number 1, item number 1 and was affirmed as a final order on November 23, 2015, with respect to a workplace located at 312 West Portage Avenue, Sault Sainte Marie, MI 49783.
