29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  The employer failed to provide abatement certification related to the hearing conservation citations that were issued February 24, 2017.

29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment.   a)  The employer had not implemented a hearing conservation program. On February 22, 2017, the Saw Mill - Slab Grader was exposed to a 427 minute dose of 194% which is equivalent to an 8 hour time-weighted average of 95.7 dBA.      b)  The employer had not implemented a hearing conservation program. On February 22, 2017, the Saw Mill - Slab Technician was exposed to a 326 minute dose of 107.2% which is equivalent to an 8 hour time-weighted average of 90.5 dBA.     c)  The employer had not implemented a hearing conservation program. On February 22, 2017, the Pallet Shop - Pallet Assembler was exposed to a 425 minute dose of 125.4% which is equivalent to an 8 hour time-weighted average of 91.7 dBA.     d)  The employer had not implemented a hearing conservation program. On February 22, 2017, the Pallet Shop - Saw Operator was exposed to a 292 minute dose of 85.5% which is equivalent to an 8 hour time-weighted average of 88.8 dBA.     An effective hearing conservation program includes, but is not limited to, the following:  1. Audiometric Testing.  2. Providing hearing protection for employee use.  3. Employee training on the Occupational Noise Exposure standard, the effects of noise to the employee and training on the purpose of audiometric testing.  4. Ensure the Occupational Noise Exposure standard is available to affected employees.  5. Recordkeeping of exposure monitoring and audiometric testing.

29 CFR 1910.95(i)(2)(i): Employers shall ensure that hearing protectors are worn by an employee who is required by paragraph (b)(1) of this section to wear personal protective equipment. 29 CFR 1910.95(b)(1): When employees are subjected to sound exceeding those listed in Table G-16, feasible administrative or engineering controls shall be utilized. If such controls fail to reduce sound levels within the levels of Table G-16, personal protective equipment shall be provided and used to reduce sound levels within the levels of the table.  a)  The employer did not require hearing protection to be worn when employees were exposed to 8 hour time-weighted average exposures over 90 dBA.
