29 CFR 1910.146(d)(4)(iii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not ensure that communications equipment was maintained properly:     a. On or about January 14, 2017, in the phosphate area, employees were required to work inside a wash tank, a permit required confined space.  The employer did not ensure an adequate number of attendant communication radios were maintained properly while performing confined space entries. The employees were exposed to the hazards related to the lack of prompt rescue services.

29 CFR 1910.146(e)(2): Before entry began, the entry supervisor identified on the permit did not sign the entry permit to authorize entry:     (a) On or about January 14, 2017, in the phosphate area, employees were required to work inside a wash tank, a permit required confined space.  The employer did not ensure the confined space entry permits for the phosphate cleaning operation were signed by the person identified.  Thereby exposing the employees to hazards associated with unverified permit entry conditions.

29 CFR 1910.146(j)(2): The employer did not ensure that each entry supervisor verified, by checking that the appropriate entries had been made on the permit, that all tests specified by the permit had been conducted and that all procedures and equipment  specified by the permit are in place before endorsing the permit and allowing entry to begin;     a. On or about January 14, 2017, in the phosphate area, employees were required to work inside a wash tank, a permit required confined space.  The employer did not ensure the confined space permit was signed in the supervisor space by the responsible person.  Employees were thereby exposed to  the hazards associated with unverified permit confined space entries.

The employer did not retain copies of the permits (or complete permits) for the  required permit confined space entries for dates during the last six months.  The employer therefore could not evaluate the confined space program for effectiveness.

The employer did not ensure all employees assigned the attendant duty were properly trained.  Thereby exposing the employees to the hazards of confined space entry.

On or about January 14, 2017, in the phosphate area,  employees (authorized entrants) were required to work inside a wash tank, a permit required confined space. The attendant spoke English and the authorized entrants spoke Spanish. The employer did not ensure that employees working as authorized entrants were able to communicate with the attendant as necessary.
