OSH Act of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees inside and outside of the facility were exposed to the combustible dust explosion, deflagration, and other fire hazards resulting from an internal dust collector deflagration or fire event within one of two outdoor unprotected filter media dust collectors.    On or about February 27, 2017, the outdoor Murphy-Rogers model WBS 94D (S/N 1005) and Murphy-Rogers model MRM 124D (S/N 1173) filter media dust collectors collecting a mixture of combustible DuPont Corian Solid Surface Material were located in near proximity to a means of egress (building entry/exit), a break area, and a yard area containing stored process materials.  The two dust collectors lacked means of (1) explosion protection, (2) deflagration propagation protection (isolation), and (3) fire protection.  The outdoor dust collectors flanked a means of egress (access door), were located in immediate proximity to a break area, and were located near materials in storage.   The outdoor dust collectors returned exhaust air directly into the occupied building.     In the event of an internal deflagration, any employees outside of the building and in proximity to the dust collector may be exposed to explosion hazards resulting from vessel failure from over pressurization such as a resulting pressure wave, expanding flame front (fire ball), and missile fragments.   In the event of an internal deflagration, employees both inside and outside of the building may be exposed to propagating flame front hazards due to unprotected vessel connections such as the dirty air inlet, dirty air return outlet, and the vessels material discharge outlet.  Finally, in the event of an internal fire, employees inside of the building may be exposed to the hazardous byproducts of an internal fire such as smoke, toxic gases, embers, and flames.          Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.22(a)(1): (1) All places of employment, passageways, storerooms, service rooms, and walking-working surfaces are kept in a clean, orderly, and sanitary condition.    On or about February 27, 2017, employees working in the solid surface shop were exposed to fire and explosion hazards due to an excessive accumulation of dust on surfaces throughout the shop.  The employer failed to ensure that the solid surface shop was kept in a clean condition through adequate housekeeping methods and schedules.    Abatement certification is required for this item in accordance with 1903.19(c).
