29 CFR 1926.252(a): Whenever materials are dropped more than 20 feet to any point lying outside the exterior walls of the building, an enclosed chute of wood, or equivalent material, shall be used. For the purpose of this paragraph, an enclosed chute is a slide, closed in on all sides, through which material is moved from a high place to a lower one. Employees were exposed the hazard of being struck by debris. There was no chute when debris was being dropped more than 20 feet outside the exterior walls of the building. Debris was being dropped from the roof to the parking lot without an enclosed chute.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. An employee was exposed to a fall of approximately 40 feet. The employee was throwing debris off the edge of the roof. The employee was not protected from falling by use of guardrail systems, safety net systems, or personal fall arrest systems.
