Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: At the corner of FM 1976 and Old Cimarron; On or about March 3, 2017, employees were exposed to struck-by hazards while in an excavation greater than 9 feet in depth by 14 feet in width by 75 feet in length, when locating a water main line in an excavation with a spoil pile located less than 2 feet from the excavation wall.

29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart: At the corner of FM 1976 and Old Cimarron; On or about March 3, 2017, employees were exposed to struck-by hazards while in an excavation greater than 9 feet in depth by 14 feet in width by 75 feet in length, when locating a water main line in an excavation that was not properly benched to protect employees.
