Section 5(a)(l) of the Occupational Safety and Health Act (the "Act"), 29 U.S.C. � 654(a)(l), rather than a violation of Section 5(a)(2) of the Act, 29 U.S.C. � 654(a)(2). The penalty for amended Serious Citation 1, Item 1 is amended to $3,385.50. The alleged violation description of amended Serious Citation 1, Item 1 is amended to state: OSH Act of 1970 Section 5 (a)(l): the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to eye damage caused by rays during arc welding: O n or about March 6, 2017, the employer failed to keep the workplace free of a recognized hazard that was either causing or likely to cause death or serious physical harm despite a feasible method to correct the hazard: specifically, the employer did not ensure that arc welding rays in the axle preparation area were blocked by a booth or screens, thus creating exposure to employees working in and moving through the area who did not have eye protection to shield rays during arc welding. On March 6, 2017, among other methods, one feasible and acceptable means to correct the hazard was to utilized booths or screens around the axle preparation area to block arc welding rays.
