29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Machine operator: On or about March 9, 2017 and at times prior; the employer exposed the employees operating in the 35 Flexo area to noise at levels of 52.9% (equivalent to an 8 hour time weighted average TWA of 85.4 dBA) which is 1.3 times the action level of 40% (equivalent to an 10 hour TWA of 83.4 dBA) while working in the Capitol Container Plant. Results were calculated for a 480 minutes sampling period during a 10 hour shift. The employer did not administer a continuing, effective hearing conservation program. b) Machine operator: On or about March 9, 2017 and at times prior; the employer exposed the employees operating in the 66 x 190 machine area to noise at levels of 54.2% (equivalent to an 8 hour time weighted average TWA of 85.5 dBA) which is 1.4 times the action level of 40% (equivalent to an 10 hour TWA of 83.4 dBA) while working in the Capitol Container Plant. Results were calculated for a 480 minutes sampling period during a 10 hour shift. The employer did not administer a continuing, effective hearing conservation program.
