29 CFR 1910.95(g)(6): At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels :   a)  Flexoseal 35 X 85 operator:   On or about November 2, 2017 and at times prior to, an employee was exposed to noise dose at levels of 61.2% (equivalent to an 10 hour time weighted average TWA of 86.46 dBA) which is 1.53 times the action level of 40% (equivalent to an 10 hour TWA of 83.4 dBA) while working at the Flexoseal 35 X 85 machine and was not provided a baseline or annual audiogram.  Capitol Container, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.95 (g)(6), which was contained in OSHA inspection number 1215607, citation number 1 , item number 1 b and was affirmed as a final order on March 9, 2017, with respect to a workplace located at 2555 Container Drive, Montgomery, AL 36109.

29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program:  a)  Flexoseal 35 X 85 operator:   On or about November 2, 2017 and at times prior to, an employee was exposed to noise dose at levels of 61.2% (equivalent to an 10 hour time weighted average TWA of 86.46 dBA) which is 1.53 times the action level of 40% (equivalent to an 10 hour TWA of 83.4 dBA) while working at the Flexoseal 35 X 85 machine and was not provided training on noise hazards. 29 CFR 1910.305(b)(2)(i): Pull boxes, junction boxes, and fittings were not provided with covers approved for the purpose:  a)    Restroom next to Flexo 35 X 85: On or about November 02, 2017 and at times prior to, the employer exposed employees to electrical burns, and shock hazards, in that the 110 volt outlet used for the bathroom light switch did not have a cover on it.    b)    Restroom next to Flexo 35 X 85: On or about November 02, 2017 and at times prior to, the employer exposed employees to electrical burns, and shock hazards, in that the 110 volt outlet used to plug in the operators fan did not have a cover on it.
