29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired: On or about March 08, 2017, employees were using a damaged ladder to access the roof of a residential home to perform roofing work. Employees were exposed to fall hazards.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about March 08, 2017, the employer did not instruct his employees in the recognition of unsafe conditions or how to eliminate any hazards. Employees were wearing harnesses but were not attached to an anchor point which exposed them to fall hazards greater than six feet to the ground below. Juan Torres was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.21(b)(2), which was contained in OSHA inspection number 100047, citation number 1, item number 2 and was affirmed as a final order on November 24, 2014, with respect to a workplace located at 14505 Hunters Grove Ave., El Paso, TX 79938.
