29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level. a) 59 New View Ave., Kearny, NJ Employees were working on a Tubular welded framed scaffold approximately 125 inches (10 feet & 5 inches) above the next lower level, without the use of any personal fall arrest system; there-by exposing employees to falling to the ground below. Violation occurred on or about 03/09/2017.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used: a) 59 New Lawn Ave., Kearny, NJ Employees were conducting masonry work from a tubular welded framed scaffold approximately 10 feet & 5 inches above the ground below without being provided with a proper means of access and/or egress in accordance with 29 CFR 1926.451(e)(1). Violation observed on or about 03/10/2017 Gena & Sons Construction Corp. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(e)(1), which was contained in OSHA inspection number 957939, citation number 1, item number 1 and was affirmed as a final order on 04/04/2014 , with respect to a workplace located at 223 1st Street, Jersey City, NJ 07302.
