29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  On or about March 09, 2017, and at times prior thereto, three employees were not protected by eye or face protection while using mud trowels on the construction site, exposing the employees to the hazard of being struck by flying debris or the corner of the trowels.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design:  On or about March 09, 2017, and at times prior thereto, employees were working on the two tier scaffolding erected next to the commercial property under construction, the scaffolding system had multiple deficiencies, such as: not being fully planked, missing ladders and no guard rails on the second tier.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):   On or about March 09, 2017, and at times prior thereto, three employees were conducting stucco work on top of the second tier of the two tier scaffolding system and it was not fully planked between the uprights, exposing the employee to a fall hazard of approximately 14 feet.

29 CFR 1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates, mud sills or other adequate firm foundations:  On or about March 09 2017, and at times prior thereto, the scaffolding erected next to the commercial property under construction was missing base plates and mud sills on several areas of the legs' upright supports, exposing employees to the hazard of a scaffold collapse.

On or about March 09, 2017, and at times prior thereto, three employees were performing stucco work from the two tier scaffolding system erected next to the commercial property under construction and all three used the cross braces and the frame of the scaffolding as a means of getting off the scaffolding, exposing employees to the hazard of falling approximately 14 feet.
