29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause them to lose balance and fall: (a) On or about March 3, 2017, Carmelo Construction, LLC. did not ensure that employees using ladders were not carrying objects that could cause them to lose balance and fall. An employee of Carmelo Construction, LLC. was observed using a ladder while conducting calls on his cellular phone. Employee was carrying the device in one of his hands while climbing down the ladder. Employee was exposed to falls of up to 9 feet. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On or about March 3, 2017, Carmelo Construction, LLC. did not ensure that its employees were protected from falls while working at heights greater than 6 feet. Employees of Carmelo Construction, LLC. were exposed to fall hazards of up to 9 feet while engaged in roofing activities on a one- story residential building with no fall protection in place. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet"). Carmelo Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1173168, citation number 2, item number 1 and was affirmed as a final order on October 25, 2016, with respect to a workplace located at 7 Burgundy Ln, Highlands Ranch, CO 80126. Carmelo Construction, LLC. dba Carmelo Gutierrez Roofing, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 979735, citation number 1, item number 1 and was affirmed as a final order on July 23, 2014, with respect to a workplace located at 4161 S Laredo Way, Aurora, CO 80013.
