29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a. On or about March 15, 2017, on the production floor of the facility, employees operating forklifts and employees on foot were required to share the same permanent aisles and passageways. The employer did not ensure that aisles and passageways were clearly defined and appropriately marked. Employees were thereby exposed to struck by hazards.

Warehouse Area: On or about March 15, 2017, the following forklift truck was not kept in a safe working condition, thereby employees were exposed to struck by hazard(s). 1. Mitsubishi Model Number FBC25N, Serial Number A4BC240610- Right front and right rear tires were unserviceable. both were excessively worn and gouged. 2. Mitsubishi Model Number FBC25N, Serial Number A4BC240610- Load backrest extension was damaged/bent in three (3) sections.
