29 CFR 1910.272(j)(2)(ii): The employer did not immediately remove any fugitive grain dust accumulations whenever the exceeded 1/8 inch (.32cm) at priority housekeeping areas, pursuant to the housekeeping program for grain elevators. On or about March 8, 2017, the employer did not ensure that explosive fugitive grain dust accumulations exceeding 1/2 inch located in the truck unloading area above the boot pit were immediately removed. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.307(c)(3): Equipment was not safe for the location in that it was not of a type and design that the employer demonstrated would provide protection from the hazards arising from the combustibility and flammability of vapors, liquids, gases, dusts, or fibers involved. On or about March 16, 2017, electrical equipment in the Leg Room including, but not limited to circuit breaker panels, fuse boxes, disconnect switches, and glass plug fuse boxes were not designed for a Class II location. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
