29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: (a) Alejandro Hernandez, at 7999 E. Kenyon Ave., Denver, CO 80237: On and before November 10, 2016, the exposing employer did not ensure that employees using pneumatic nail guns to attach roof tiles utilized appropriate eye protection. Condition exposed the employees using the pneumatic nail gun to eye and face hazards from flying particles.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were the employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Alejandro Hernandez, at 7999 East Kenyon Avenue Denver, CO 80237: On or before November 10, 2016, the employer did not insure that employees were using fall protection when shingling a ranch style single family home with a 5/12 pitch. Three employees were shingling a roof without the use of harnesses and personal fall arrest systems. This condition exposed employees to fall hazards of approximately 10 feet.

29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access: (a) Alejandro Hernandez, at 7999 E. Kenyon Ave., Denver, CO 80237: On and before November 10, 2016, the exposing employer failed to ensure that a portable metal ladder in use to gain access to an upper landing surface extended at least 3 feet above the upper landing surface or that a grasping device, such as a grabrail, was provided to assist employees in mounting and dismounting the ladder. Condition exposed employees to an approximately 10 foot fall hazard.
