OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards from rails and rail transport equipment: (a) On or about March 14 , 2017, and at times prior, employees in the load-out stands area were exposed to struck-by and crushing hazards from moving rails and rail transport equipment while loading rails on trains. Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: (a) On or about March 14, 2017, and at times prior, the employer did not ensure that protective equipment was used when necessary whenever hazards capable of causing injury and impairment were encountered. The employer did not enforce the use of steel-toe boots with metatarsal protection for employees loading rails on trains. Employer requires and provides appropriate footwear but does not enforce its use exposing employees to crush-by hazards. Abatement Note: Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").
