29 CFR 1903.19(c)(1): Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  The employer did not certify that the citations issued on June 16, 2017 related to forklift attachments, electrical hazards, and the storage of Oxygen and Acetylene were abated.

29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  The employer did not provide abatement documentation proving that the hazard related to the storage of Oxygen and Acetylene was abated for the citation that was issued on June 16, 2017.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.  On or about March 20, 2017, the employer utilized unapproved fork extensions and a spreader bar to lift and move shipping containers with a JCB Model 512-56 rough terrain forklift without the manufacturers approval.

29 CFR 1910.303(b)(2): Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.  (a)  On or about March 20, 2017, metallic outlet boxes (handy boxes) were not installed in accordance with the UL identifier OCIT which states the boxes shall be mounted in or on a surface.  The metallic outlet boxes were attached to 240 volt extension cords to power welders and plasma cutters in the fabrication shop.  (b)  On or about March 20, 2017,  type NM-B non-metallic sheathed flexible cable was ran through an exterior wall and alongside the ground to power an outlet and unused paint booth on the west side of the fabrication shop.

29 CFR 1910.253(b)(4)(iii): Oxygen cylinders in storage shall be separated from fuel-gas cylinders or combustible materials (especially oil or grease), a minimum distance of 20 feet (6.1 m) or by a noncombustible barrier at least 5 feet (1.5 m) high having a fire-resistance rating of at least one-half hour.  On or about March 20, 2017, oxygen cylinders were stored alongside acetylene and propane cylinders in storage areas on the east and west side of the fabrication shop.    MODS International Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.253(b)(4)(iii), which was contained in OSHA inspection number 988175, citation number 1, item number 2, and was affirmed as a final order on October 27, 2014, with respect to a workplace located at 5523 Integrity Way Appleton, WI 54913.
