29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system; On or about; March 24, 2017 Location: Third floor level, roof top of the lumber beams, And second and third floor levels window openings, right side of the house, new residential construction: 42 Ostilla Ave. New Square, NY a) One employee engaged in residential construction activities, standing on the top of a lumber beam at the third floor level (approximately 30 feet above the ground) while unloading lumber from a forklift, was not protected from falls by guardrail systems, safety net system, or personal fall arrest system. b) Four employees engaged in residential construction/framing activities, walking/working at the second and third floor levels in close proximity to window openings less than 39 inches above the walking/working level, were not protected from falls by safety net system, personal fall arrest system or adequate guardrail systems, with a top rail at least 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level.
