29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Shop Area: On or about March 30, 2017, and at times prior, the employer exposed employees to struck-by and crushed-by hazards in that employees were allowed to operate a forklift with a NewTec, Inc. 5th Wheel / Receiver Hitch Attachment that had not been certified by the manufacturer of the forklift and did not have updated instruction plates, tags, or decals. b) Shop Area: On or about March 30, 2017, and at times prior, the employer exposed employees to struck-by and crushed-by hazards in that employees were allowed to operate a forklift with a 5th Wheel / Receiver Hitch Attachment of unknown manufacturer, that had not been certified by the manufacturer of the forklift and did not have updated instruction plates, tags, or decals.
