29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation. 33 Allen Road, Holden, MA: On or about March 29, 2017 employees were working in a trench in which water was accumulating and adequate precautions were not taken to protect employees from the hazards posed by water accumulation which resulted in the partial collapse of the trench wall and injuring an employee.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not made after every rainstorm or other hazard increasing occurrence: 33 Allen Road Holden, MA: On or about March 29, 2017 the inspection conducted by the competent person had not identified the hazards associated with active water intrusion along the face of the excavation which increased the likelihood of a trench wall collapse exposing employees to engulfment hazards. Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).
