29 CFR 1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: On or about March 29, 2017 at a worksite located at 7801 Emeril Bay Ave, Jackson Township, OH 44614, during residential framing including leading edge work activities, the employer did not ensure employees were protected from eye hazards by ensuring eye protection was available and worn while operating pneumatic nail guns at approximately 120 psi and a circular saws.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): On or about March 29, 2017, at a worksite located at 7801 Emeril Bay Ave, Jackson Township, OH 44614, during residential framing activities, the employer did not ensure employees were protected from fall hazards of approximately 10 feet by ensuring a fall protection system/device was being used. Stutzman Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1192096, citation number 01, item number 02, and was affirmed as a final order on December 20, 2016, with respect to a workplace located at 5575 Cranmer Circle, Medina, OH 44256.
