29 CFR 1910.178(l)(4)(ii)(B): Refresher training and evaluation was not provided to the operator when the operator was involved in an accident or near-miss incident. On or about March 17, 2017, a powered industrial vehicle operator was involved in an accident while handling product in the shelving unit, which resulted in a pallet containing material falling from the second tier of a shelving unit to the floor. The employer did not conduct refresher training to prevent struck by hazards following the accident. No abatement certification or documentation is required for this item.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: On or about April 3, 2017, employees in the Dry Powder Department were exposed to eye and skin irritation when required to work with chemicals such as, cement containing silica, citric acid, Bermocoll E 230X, Agocel S 5300, and Mermodol AEA 2800, on a routine basis. The employer did not ensure employees were trained on the associated safety and health hazards to prevent injury and illness, in accordance with the hazard communication standard. No abatement certification or documentation is required for this item.
