29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: Worksite: When employees were assigned to abrasively remove damaged brick and mortar from the exterior of a building, the employer did not ensure that employees were trained to recognize and avoid exposure to silica-containing dust generated during these activities. Such avoidance would include, but not be limited to, use of adequate respiratory protection, Tyvek suits or equivalent protective clothing, wash stations, and HEPA vacuums to remove silica-containing dusts from clothing, surfaces, and tools.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program which at included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): (Construction Reference: 1926.59): Worksite: When employees are exposed to silica-containing dusts during abrasive chipping and grinding of brick and mortar, the employer did not develop and implement a written hazard communication program that would inform employees of the hazards to which they would be exposed, list those hazards, and tell the employees the methods the employer will use to inform them of the hazards of non-routine tasks.
